TERMS AND CONDITIONS OF HIRE

1.1 In these Conditions the following words shall have the following meanings: "The Customer" means the Customer referred to in the Order Form; "Goods" means the Goods stated in the Order Form overleaf; "The Owner" means Table Linen Company Limited of Unit 1 Cornbrook Park Road, Manchester M15 4EE; "Order Form" means the Order Form overleaf;

2. The Goods

2.1 The Owner agrees to hire the Goods to the Customer for the period of hire stated in the Order Form. The Goods shall at all times remain the property of the Owner.

2.2 The Customer is solely responsible for the Goods during the period of hire and for insuring them from the time the Goods are collected by them (or delivered to them by the Owner) until the Goods are returned and accepted back into the possession of the Owner.

3. Collection/Delivery

3.1 The Goods will be available for collection at the collection address stated in the Order Form unless otherwise agreed by the Owner. If the Owner is required to deliver or collect the Goods, a delivery/collection charge will be made.

3.2 When the Goods are collected by or delivered to the Customer, the Customer shall inspect the Goods and sign the Owner's delivery note. In the event of any shortage or damage, the Customer shall endorse the delivery note accordingly at the time of collection or delivery. If the Customer fails to perform any of its obligations under this condition, the Goods will be deemed to have been collected/delivered in a clean and undamaged condition.

3.3 The Customer shall advise the Owner in writing of the name of the authorised signatory for the Goods in good time prior to their collection/delivery.

4. Return of the Goods

4.1 The Customer agrees to return the Goods to the Owner on the return date as specified in the Order Form. The Goods must be returned during the Owner's normal business hours, unless otherwise agreed by the Owner.

4.2 Any extension to the hire period must be agreed by the Owner and the Customer will be charged extra at a pro rata rate.

4.3 The hire period shall be deemed to continue until all the Goods are returned to the possession of the Owner.

4.4 In the case of late return of the Goods a hire charge equivalent to [the daily hire rate] will be made.

4.5 Any goods returned which do not belong the Owner will be notified to the Customer. If they are not collected within 28 days of notification, the Owner reserves the right to dispose of them.

4.6 All Goods must be returned in the original cartons and crates. Loss of or damage to any cartons or crates will be charged at full replacement cost.

4.7 Wet linen must not be placed in plastic bags. Any mildew damage will result in the Customer being liable to additional charges for replacement of the linen.

4.8 If linen is stained by candle wax or grease, an additional cleaning charge will be levied to the Customer. If either substance cannot be removed then the Customer will be charged for the cost of replacement of the linen in addition to the cleaning charges.

4.9 Shortages and or damage to hired of theGoods will be charged at their full replacement value, details of which are available on request.

5. Terms of Payment

5.1 A non-refundable deposit of 50% of the hire charge is payable when the Order is placed.

5.2 The balance of the hire charge is payable within 14 days of the date of the Owner's invoice.

5.3 Any shortage or damage to the Goods or packaging will be charged according to the full replacement value at the time of hire.

5.4 All prices are subject to VAT, for which the Customer shall be additionally liable.

5.5 Unless otherwise stated, all payments must be made within 14 days of the date of the Owner's invoice.

6. Cancellation

If the Customer wishes to cancel the Order, this must be notified to the Owner in writing. The deposit paid pursuant to clause 5.1 will be retained by the Owner.

7. Liability

7.1 The Owner shall not be responsible for any injury or damage to persons or property arising from the Goods unless this can be shown to have occurred as a result of the negligence of the Owner.

7.2 The Owner will not be responsible for any indirect or consequential loss howsoever arising.

8. General

8.1 These terms of hire shall be subject to English law and the English courts will have jurisdiction in respect of any dispute arising.
